ORDINANCE NO. 1705 OF 2017
ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES OF THE CITY OF RUSTON, LOUISIANA BY CHANGING CERTAIN OF THE DISTRICT BOUNDARIES PROVIDED FOR THEREIN
WHEREAS, application was made under Case No. 1298 to the Zoning Commission of the City of Ruston, Louisiana, for reclassification of property referred to below:
Case No. 1298: Application for Zoning Amendment - From R-25 to PUD, Planned Unit Development in conformance with submitted preliminary plat, which is attached hereto as Exhibit B.
Applicant: Total Properties, Inc.
Location: Vacant Lot on south side of West Barnett Springs Ave. and south of the dead end of Wiltshire Lane
Legal Description:
Commencing at a found _” iron rod at the northwest corner of said Section 27, run thence along the west line of said Section 27 south 00°27'24” west for a distance of 139.89 feet to a found _” iron rod at the southwest corner of lot 20 of Wiltshire Subdivision, as recorded in book 1135, page 87, of the records of Lincoln Parish, Louisiana. Said found _” iron rod also being the point of beginning of the tract herein described. From said point of beginning, run thence along the south line of said Wiltshire Subdivision south 89°22'48” east for a distance of 953.72 feet to set _” iron pipe at the southwest corner of lot 2 of said Wiltshire Subdivision. Said set _” iron pipe also being the northwest corner of lot 21 of Wiltshire Subdivision Unit 2, as recorder in book 1169, page 802, of the records of Lincoln Parish, Louisiana. Thence run along the west line of said Wiltshire Subdivision Unit 2 south 00°35'17” west for a distance of 200 feet to a set _” iron pipe at the southwest corner of lot 24 of said Wiltshire Subdivision Unit 2, thence run along the south line of said Wiltshire Subdivision Unit 2 south 89°24'43” east for a distance of 160.38 feet to a set _” iron pipe at the southeast corner of said Wiltshire Subdivision Unit 2, thence run south 00°35'17” west for a distance of 77.22 feet to a found _” iron rod, thence run south 89°32'02” east for a distance of 890.93 feet to a set _” iron pipe, thence run south 00°13'42” west for distance of 1935.80 feet to a set _” iron pipe, thence run north 89°23'27” west for a distance of 1463.84 feet to a set _” iron pipe in the centerline of Tanyard Branch, thence run northerly along the approximate centerline of Tanyard Branch the following thirteen calls: North 08°08'35” East for a distance of 110.28 feet to a found _” iron rod, north 63°56'47” west for a distance of 31.36 feet to a found 3/8” iron rod, north 12°47'43” east for a distance of 175.37 feet to a found _” iron rod, north 46°17'42” west for a distance of 125.71 feet to a set _” iron pipe, north 12°53'12” west for a distance of 213.94 feet to a found _” iron rod, north 12°24'59” east for a distance of 117.38 feet to a found _” iron rod, north 31°34'01” east for a distance of 90.29 feet a found _” iron rod, north 83°23'45” east for distance of 46.20 feet to a set _” iron pipe, north 07°38'35” west for a distance of 112.01 feet to a set of _” iron pipe, north 55°20'17” east for a distance of 33.67 feet to a set _” iron pipe, south 81°35'28” west for a distance of 132.12 feet to a found cotton spindle, north 33°55'40” west for a distance of 74.75 feet to a found cotton spindle, north 10°59'06” west for a distance of 62.10 feet to a set _” iron pipe, thence run north 89°27'56” west for a distance of 376.71 feet to a found 5/8” iron rod on the west line of said section 27, thence run along said west line of section 27 the following two calls: north 00°33'33” east for a distance of 892.98 feet to a found _” iron rod, north 00°31'11” east for a distance of 300.13 feet to the point of beginning. Said tract containing 84.003 acres. Lincoln Parish Assessor's Parcel 27183000022
WHEREAS, the property requested to be reclassified is shown on attached Exhibit A and Exhibit B; and, WHEREAS, the preliminary plat of the planned unit development, Tanyard Creek, is attached and made a part of this Ordinance as Exhibit B and the Restrictive Covenants of the development are attached as Exhibit C ”; and, WHEREAS, after notice and advertisement regarding such application, a public hearing was held by said Zoning Commission on April 17, 2017 and a public hearing was also held by the Planning Commission on April 17, 2017; and,
WHEREAS, on April 17, 2017, the Zoning Commission recommended that the property be reclassified as requested and the Planning Commission recommended that the preliminary plat of Tanyard Creek be approved, conditioned upon compliance with City codes and requirements; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
1. Chapter 29 of the Code of Ordinances of the City of Ruston, Louisiana is hereby amended so as to reclassify the above described property to PUD Planned Unit Development and approve the preliminary plat of Tanyard Creek, conditioned upon compliance with City codes and requirements.
§2. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed, it being intended; however, that this Ordinance shall not in any manner change said Chapter 29 of the Code of Ordinances of the City of Ruston, Louisiana, except to reclassify the above described property to PUD Planned Unit Development.
§3. If any one or more of the provisions of this Ordinance shall, for any reason, be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this Ordinance, but this Ordinance shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provision enacted after the date of this Ordinance which validates or makes legal any provision of this Ordinance which would not otherwise be valid or legal, shall be deemed to apply to this Ordinance.
§4. This Ordinance shall become effective upon final adoption and publication of same in the manner prescribed by law.
This Ordinance was introduced on May 1, 2017, by Alderwoman Angela Mayfield; Notice of public hearing was published on May 5, 2017, May 12, 2017, and May 19, 2017, and said public hearing having been held; the title having been read and the Ordinance considered, on motion to adopt by Alderman Bruce Siegmund, seconded by Alderman Jedd Lewis, a record vote was taken and the following result was had:
