RESOLUTION NO. 833 OF 2013
RESOLUTION AUTHORIZING THE SALE OF VEHICLES AND EQUIPMENT AS SURPLUS MOVABLE PROPERTY
WHEREAS, the City presently has vehicles and equipment (the “Vehicles and Equipment” or “Property”) that cannot be utilized by the City and are not needed for public purposes; and, WHEREAS, the Vehicles and Equipment are currently situated at the Public Works Department at 701 E. Tennessee Avenue, Ruston, Louisiana; and, WHEREAS, each of the Vehicles and Equipment is movable property having an appraised value of five thousand dollars or less, is no longer needed for public purposes and, as such, it is in the best interest of the City that said Vehicles and Equipment be disposed of through private sale; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The Vehicles and Equipment are hereby declared to be no longer needed for public purposes.
§2. The City sell the Vehicles and Equipment pursuant to the following terms and conditions:

B. Other Terms and Conditions:
(1) All Property shall be sold without warranty;
(2) Unless otherwise indicated, Vehicles and Equipment must be removed by the purchaser at its expense within thirty (30) days of the date of sale; and,
(3) Payment shall be made to the City in cash on or before date of sale.
§3. The City Purchasing Agent is authorized and empowered to publish a notice that the Vehicles and Equipment are offered for sale to the highest bidder or bidders submitting sealed bids and to consummate the sales, provided that the price offered is equal to or greater than the minimum price set forth above. However, if no acceptable bids are received after the proposed sale is advertised one (1) time, (a) the Vehicles and Equipment may be re-advertised for sale as set forth above, or (b) the Vehicles and Equipment may be sold for the amount of the highest bid received or for the highest amount that can be obtained by the City Purchasing Agent whether or not such amount is equal to or greater than the minimum price set forth above, or (c) if no amount can be obtained for any of the Vehicles and Equipment, they may be disposed of in any reasonable manner. The Purchasing Agent or the Mayor is authorized to sign any acts of sales or other documents as may be required to convey title to the purchaser of the Vehicles and Equipment.
§4. This Resolution shall become effective upon final adoption and signature of the Mayor.
This Resolution after having been read and considered on motion to adopt by Alderman Jim Pearce, and seconded by Alderman Jedd Lewis, a record vote was taken and the following result was had:
