Monthly Meeting
December 6, 2012
Mayor Edward R. Jones opened the regular session of the Grambling City Council at 6:00 p.m. at Grambling City Hall. Mr. William Arrington offered the invocation and led the council and congregation into the Pledge of Allegiance. Present were the following Council members: Birdex Copeland, Jr., Yanise Days, Cathy Holmes, Cullen Jackson and Roy Jackson. It was moved by Council member Roy Jackson and seconded by Council member Yanise Days to adopt the Minutes dated November 1, 2012.

The motion was carried to adopt the minutes of the Meetings dated November 1, 2012. It was moved by Council member Birdex Copeland, Jr. and seconded by Council member Cullen Jackson to adopt the agenda as presented.
Part II. Comments, Information, and Presentation:
Public Comment:
To Comply with ACT No. 850 H.B. No. 1307 the Mayor allowed time for the Public to make comments concerning any presented Agenda items. No Comment.
Police Department
Chief Tommy Clark, Jr. stated that the 911 Commission Meeting will be Wednesday, December 28, 2012, at 2:30 p.m. in the Police Juror Room.
Fire Department
Chief David Wells gave the following report:
February 22, 2012 LaBradford Scroggins was hired as Probationary Firefighter Recruit.
October 1, 2012 Jerry Davis resigned as a firefighter.
October 5, 2012 Damion Bradley was hired as a Probationary Firefighter Recruit.
On November 1, 2012 Mr. Tarak Patel donated $1000 to the fire department for the purpose of purchasing new uniforms on behalf of Shreveport Hampton Inn and Hampton Inn Express.
All radios for the city will be changing to a narrowband frequency which is mandated by the Federal Government January 2013.
Administrative Department
1. Mr. Dean Dick, Engineer, gave the following status report:
Project # Project Description/Project Status
2147 Recreational Trail Grant - Amended scope of work forwarded for approval on 8/22/12. Memorial Drive sidewalks are proposed for initial phase.
2221 Well #7 - EPA Appropriation Funding awarded for $291,000 was determined to require a 45% match by the applicant unless a waiver was awarded based on financial burden to the users. No word on the request for a waiver has been received as of this date.
2409 Well #4 - QRI of Baton Rouge was issued a Notice To Proceed establishing the start of construction as 12/03/2012.
2447 LGAP 2011-2012 (Sewer) - Soliciting proposals from qualified Contractors to repair three (3) house services known to be under DHH violation notice.
2500 WWTP Aerator Lease/Purchase installation - both aerators have been installed, resulting in rapid turnover of the plant, elevated dissolved oxygen levels recorded, excellent mixing and velocity observed. Continuation of current operation of both units is anticipated until effluent quality compliance is confirmed with this month's monitoring.
2530 FY2012 LCDBG rehabilitation of West College Street - Advertisement for bids is scheduled for the week of the 14th of December to allow opening of bids after the holidays.
2563 Mansfield Estates - Design/Build being coordinated by investment firm with no local input.
2564 FY 2012-2013 LGAP Funding - Application submittal date is 9/14/2012.
2. The Mayor presented Mrs. Bettye Giles a plaque for being dominated to receive the Alice Foster Award.

It was moved by Council member Roy Jackson and seconded by Councilmember Cathy Holmes to introduce the following: ORDINANCE NO. 0126012-1
AN ORDINANCE OF THE CITY OF GRAMBLING TO PROVIDE FOR THE CRIME OF INDECENT EXPOSURE/SAGGING AND ESTABLISH PENALTIES FOR VIOLATIONS THEREOF.

The motion was carried to introduce Ordinance #0126012-2. A Public Hearing will be held on the Ordinance, and the Ordinance will be considered for adoption at the Regular Meeting of the Mayor and the Council to be held at 6:00 p.m. or immediately following the Public Hearing., on February 7, 2013, Council Chambers/ Courtroom, City Hall, 127 King Street, Grambling, Louisiana. The Public Hearing will be at 5:00 p.m.
New Business:
1. It was moved by Council member Cullen Jackson and seconded by Council member Yanise Days to adopt he following:
A RESOLUTION OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF GRAMBLING REGARDING CHARITABLE GAMING AND ELECTRONIC VIDEO BINGO
WHEREAS, the City of Grambling is a political subdivision of the State of Louisiana; WHEREAS, pursuant to Grambling City Ordinance 0204 adopted in March, 2004 as amended in 2007, Charitable Gaming including Electronic Video Bingo are permitted in Grambling by duly licensed organizations and entities; WHEREAS, Ordinance 0204 as amended provides that twenty percent (20%) of the net win or net proceeds from each electronic video bingo machine shall be paid to the City of Grambling; WHEREAS, a Motion was adopted at a March 23, 2009 City Council Meeting to “amend Ordinance #204 which will allow Costal Bingo to remit 10% instead of 20% of their Net Proceeds, until the Council desires for them to pay their original percentage;” WHEREAS, the motion is the equivalent of a resolution and Louisiana law does not generally permit an ordinance to be amended by a resolution and there are no applicable exceptions;
WHEREAS, the Louisiana Revised Statute 33:406(F) permits the City Council to suspend an ordinance by complying with formalities of law but said suspensions are limited to one year and 30 days; WHEREAS, the permissible time period for suspension of an ordinance has expired, it is in the best interest of the City of Grambling to formally repeal the prior motion; NOW THEREFORE, BE IT RESOLVED, by the Mayor of Grambling and the Board of Aldermen of Grambling that the motion adopted at the March 23, 2009 City Council Meeting permitting Coastal Bingo to remit only 10% of their Net Proceeds is hereby repealed and the terms of the Ordinance 0204 as amended in 2007 are hereby applicable to Coastal Bingo and any other electronic video bingo licensee. BE IT FURTHER RESOLVED that this resolution shall be effective immediately. This resolution having been submitted to a vote on the 6th day of December, 2012, the vote thereon was as follows:

2. It was moved by Council member Cathy Holmes and seconded by Council member Birdex Copeland, Jr. to introduce:

ORDINANCE ADOPTING THE PROPOSED BUDGET OF REVENUE AND EXPENDITURES FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2013, AND ENDING DECEMBER 31, 2013, FOR THE CITY OF GRAMBLING, LOUISIANA was introduced by Council member Cathy Holmes and seconded by Council member Birdex Copeland, Jr. on December 6, 2012. A Public Hearing will be held on the Ordinance and the Ordinance will be considered for adoption at a special-called meeting of the Mayor and the Council to be held at 5:30 p.m., on December 27, 2012, Council Chambers/ Courtroom, City Hall, 127 King Street, Grambling, Louisiana. The proposed budget is now available for public inspection between the hours of 8:30 a.m. and 4:30 p.m., December 11- December 26, 2012; in the Administrative Office located at City Hall, 127 King Street, Grambling, Louisiana.

ORDINANCE PROVIDING THE DATE, TIME AND PLACE OF REGULAR MEETINGS OF THE BOARD OF COUNCIL MEMBERS OF THE CITY OF GRAMBLING, LOUISIANA FOR CALENDAR YEAR 2013 WHEREAS, the Board of Council members desires to provide notice of the regular meetings of the Board of Council members of the City of Grambling, Louisiana, for calendar year 2013 pursuant to LSA-R.S. 42:7; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNCIL MEMBERS OF THE CITY OF GRAMBLING, LOUISIANA:

Cullen Jackson to adjourn this meeting at 6:30 p.m.
