This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
REQUEST FOR RELEASE OF FUNDS
On or about November 8, 2012 the Louisiana Housing Corporation will submit a request to the HUD/New Orleans Field Office for the release of HOME funds under the HOME Investment Partnership Program 24 CFR Part 92 ,Title II of the Cranston-Gonzales National Affordable Housing Act (NAHA), in accordance with section 288 (42 U.S.C. 12838 as amended, to fund a project through Healthy Communities 101, known as Troy Street Duplex. This is for new construction for two Multi Family Rental Homes. The amount of HOME funding is $101,545 and it has a total development cost of $136,393.00. The grant number for HOME is M-11-SG-22-0100.
FINDING OF NO SIGNIFICANT IMPACT
The Louisiana Housing Corporation has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Louisiana Housing Corporation, 2415 Quail Drive, Baton Rouge, LA 70808 and may be examined or copied weekdays 8:00 A.M. to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Louisiana Housing Corporation. All comments received by November 6, 2012 will be considered by the Louisiana Housing Corporation prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing.
RELEASE OF FUNDS
The Louisiana Housing Corporation certifies to HUD/New Orleans Field Office that Don J. Hutchinson in his capacity as Interim Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's/New Orleans Field Office approval of the certification will satisfy its responsibilities under NEPA and related laws and authorities, and allow Healthy Communities 101 to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/New Orleans Field Office will consider objections to its release of funds and the Louisiana Housing Corporation certification received by November 26, 2012 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the (Louisiana Housing Corporation); (b) the (Louisiana Housing Corporation) has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD/New Orleans Field Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to: Cheryl Breaux at Department of Housing and Urban Development, 500 Poydras Street, 9th floor, New Orleans, LA 701030
Potential objectors should contact HUD/ New Orleans Field Office to verify the actual last day of the objection period.
