ORDINANCE NO. 117
AN ORDINANCE TO AMEND AND REENACT ORDINANCE NUMBERS 52, 61 AND 90 OF THE CODE OF ORDINANCES OF THE VILLAGE OF CHOUDRANT, TO PROVIDE FOR THE RATE TO BE CHARGED FOR WATER SERVICES FURNISHED TO CUSTOMERS OF THE VILLAGE OF CHOUDRANT; TO PROVIDE FOR THE EFFECTIVE DATE THEREOF; AND OTHERWISE TO PROVIDE WITH RESPECT THERETO. NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of the Village of Choudrant, Louisiana, convened in Regular Session this 6th day of August, 2012, that the following Ordinance is hereby enacted:
SECTION 1.
A deposit for the payment for water services shall be made by each customer of the Village of Choudrant and the deposit shall be based upon the size of the meter and should be made prior to connection of service as follows:

SECTION 2.
All water customers of the Village of Choudrant shall be charged and billed at the following rate for said services:

There shall be an additional twenty-five (25%) percent of the total cumulative charge for each out of town customer added to the monthly water bill of each such customer, except in the case of public water systems which are metered by master meters, in which case there shall be no twenty-five (25%) surcharge.
SECTION 3.
When required to convert water users to equivalent residential customers, divide the average monthly usage of said customer for the previous twelve month period by the average monthly usage of all 3/4” residential customers for the previous twelve month period. The number derived from that calculation shall be the number of equivalent residential customers. The water bill for such customers shall then be calculated as if the customer had the number of water connections reflected by the number of equivalent residential customers. However, in the case of mobile home parks or apartment complexes or for any customer for which there are multiple distinct measurable dwelling units, the base rate shall be $13.00 multiplied by the number of dwelling units for which the customer receives up to 2000 gallons, multiplied by the number of dwelling units. All usage over this calculated amount shall be billed at $2.00 per 1000 gallons. The average monthly water usage of customers shall be recalculated annually, to be effective April 1st of each year.
SECTION 4.
The fee to be paid for each water tap shall be as follows:

SECTION 5.
The billing procedures for water bills as set forth in Section 4 of Ordinance No. 61 of the Code of Ordinances of the Village of Choudrant shall remain in full force and effect, unchanged and unaffected by the provisions of this Ordinance.
SECTION 6.
If any section, paragraph, sentence, clause and/or phrase of this Ordinance or the application thereof is declared unconstitutional, unenforceable or invalid by the valid judgment of any court of competent jurisdiction such unconstitutionality, unenforceability or invalidity shall not affect any of the remaining sections, paragraphs, sentences, clauses and/or phrases of this Ordinance, since the same would have been enacted by the Village of Choudrant without the incorporation in this Ordinance of any such unconstitutional, unenforceable or invalid section, paragraph, sentence, clause or phrase. To that end, the provisions of this Ordinance are hereby declared severable.
SECTION 7.
All other ordinances, or any parts thereof, which are in conflict with the provisions of this Ordinance are hereby repealed.
SECTION 8.
This Ordinance shall become effective after final adoption and publication in the manner prescribed by law. The above and foregoing Ordinance was introduced on July 2, 2012, at a regular meeting of the Board of Aldermen of the Village of Choudrant, Louisiana, a public hearing having thereafter been held, title having been read, and a motion to adopt said ordinance was made by Alderman Alderman Croswell. The motion was seconded by Alderman Aswell, and after having been considered by title was adopted as a whole by the following YEA and NAY vote:
