MINUTES OF A REGULAR MEETING OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF RUSTON HELD ON MONDAY, DECEMBER 5, 2011, AT 5:30 P.M., IN COUNCIL CHAMBERS/ COURTROOM, 2ND FLOOR, CITY HALL, 401 NORTH TRENTON, RUSTON, LOUISIANA
A regular meeting of the Mayor and Board of Aldermen of the City of Ruston was held Monday, December 5, 2011, at 5:30 p.m., in the Council Chambers/ Courtroom, 2nd Floor, City Hall, 401 North Trenton, Ruston, Louisiana. A quorum was present, notice having been duly served. Mayor Dan Hollingsworth, Aldermen Jedd Lewis, Elmore Mayfield, Jim Pearce, Alderwomen Glenda Howard and Marie Riggs were present. Mayor Dan Hollingsworth called the meeting to order at 5:30 p.m., and delivered the invocation.
I. ADOPT:
A. AGENDA.
Motion was made by Alderwoman Jim Pearce and seconded by Alderwoman Glenda Howard to adopt the agenda. There were no comments from the audience. The motion passed by unanimous vote.
B. MINUTES OF NOVEMBER 7, 2011, REGULAR MEETING.
Alderman Jim Pearce made a motion, seconded by Alderman Elmore Mayfield, to approve the Minutes of the November 7, 2011, Regular Council meeting. Mayor Hollingsworth asked for comments from the audience and there were none. The motion passed by unanimous vote.
II. ADMINISTRATION:
A. CONSIDER ORDINANCE NO. ____ OF 2011, AMENDING SECTIONS 5-1 AND 5-3 OF CHAPTER 5 OF THE CODE OF ORDINANCES OF THE CITY OF RUSTON, LOUISIANA RELATING TO ALCOHOLIC BEVERAGES.
Lewis Love was present to discuss details of the proposed ordinance.
A.(1). PUBLIC HEARING REGARDING ORDINANCE AMENDING SECTIONS 5-1 AND 5-3 OF CHAPTER 5 OF THE CODE OF ORDINANCES OF THE CITY.
Mayor Hollingsworth called for a public hearing at 5:34 p.m. The following came forward to comment:
Ruth Potts, 2801 Foxxwood, Ruston, urged Aldermen to vote against the ordinance. Bobby E. Price, Immediate Past Chairman of Ruston Lincoln Chamber of Commerce, commented against approval of the ordinance citing moral issues. Scott Terry, Ruston Lincoln Chamber of Commerce, stated that he supported approval of the ordinance. Mike Holloway, 200 Convention Lane, Ruston, Pastor of Cook Baptist Church, commented against approval of the ordinance citing the negative effects of alcohol. Ted McKinney, 1607 Ravine Drive, Ruston, commented against approval of the ordinance. Maribel McKinney, 1607 Ravine Drive, Ruston, commented against approval of the ordinance. Chris Garriga, Lisa Lane of Ruston, co-owner of Log Cabin and Ponchatoulas, commented in favor of approval of the ordinance. Mark Taylor, 1200 Hwy 3072, Ruston, stated that he opposed approval of the ordinance. Josh Shirley, 206 Rough Edge Road, Ruston, spoke in favor of approval stating that it was an issue of choice for citizens. John Fleming 189 Sundance Drive, Ruston, retired minister and formerly law enforcement officer, stated that his family moved to Ruston because of family and university. Fleming stated that he is against approval of the ordinance. Charlie Jackson, 123 Baxter, Ruston, stated that because of experiences as a child relating to alcohol, he felt obligated to speak out against approval of the ordinance. Kenny O'Neil, 600 Aaron Avenue, Ruston, one of the owners of Portico, spoke in favor of approval of the ordinance. Brian Milton, 186 Bryant Road, Dubach, stated that he is not in favor of the ordinance. Ryan Dalton, 3165 Hwy. 33, Ruston, commented in favor of approval of the ordinance. Roy Mayfield, stated that Ruston is a good place to live and spoke in favor of the ordinance. Hunter Smith, 1339 Mitcham Orchard Road, Ruston, stated that he supports approval of the ordinance. Bert Davis, 102 North Homer, Ruston and owner of The Dawg House, spoke in favor of the ordinance. Harold Henderson, 700 Hundred Oaks Drive, Ruston, commented against approval of the ordinance. Maggie Brown, 1703 Corley, Ruston, spoke out against approval of the ordinance. Mary E. Holbrook, 706 Tarreyton, Ruston, commented against alcohol on Sunday and against approval of the ordinance. Jacob Haney, Ruston, commented against approval of the ordinance. The Mayor closed the public hearing at 6:24 p.m., and called for final consideration by the Aldermen. Alderman Jim Pearce addressed the Council and stated that he planned to vote against the ordinance because he had not seen a study or any data that would provide him with information that the passing of the ordinance would bring additional revenue to the City. Alderwoman Glenda Howard stated that she planned to vote for approval of the ordinance because she felt it is the best thing for the City and is an issue of choice for Ruston citizens. Alderman Elmore Mayfield stated that he was impressed with the assembly present and appreciated the number of people who came to voice their opinions. He stated that he would vote in favor of the ordinance and believes it to be the best thing for our community. Alderwoman Marie Riggs voiced her concern about the effects of alcohol on individuals and families and the added work for law enforcement officials. She stated that she will vote against approval of the ordinance. Alderman Jedd Lewis echoed comments from merchants and stated that he is in favor of alcohol sales on Sunday in restaurants. Alderman Elmore Mayfield made a motion, seconded by Alderman Jedd Lewis, to adopt the ordinance. The title of the ordinance was read, a roll call vote was taken and the following result was had:

ALDERMAN JEDD LEWIS
ALDERMAN ELMORE MAYFIELD
NAY: ALDERMAN JIM PEARCE
ALDERWOMAN MARIE RIGGS
ABSENT: NONE
The motion passed with three votes in favor of and two opposed being Alderman Jim Pearce and Alderwoman Marie Riggs. (ORDINANCE NO 1621 OF 2011)
B. INTRODUCE ORDINANCE NO. ____ 2012, AMENDING SEC. 1-10 OF CHAPTER 1 OF THE CODE OF ORDINANCES OF THE CITY OF RUSTON, LOUISIANA RELATING TO GENERAL PROVISIONS OF THE CODE OF ORDINANCES OF THE CITY OF RUSTON.
The ordinance was introduced by Alderman Jedd Lewis.
III. FINANCE:
A. CONSIDER ORDINANCE NO. ____ OF 2011, PROVIDING THE DATE, TIME AND PLACE OF REGULAR MEETINGS OF THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA FOR CALENDAR YEAR 2012.
Emmett Gibbs was present to discuss the ordinance.
A.(1) PUBLIC HEARING REGARDING ORDINANCE PROVIDING THE DATE, TIME AND PLACE OF REGULAR MEETINGS OF THE BOARD OF ALDERMEN.
Mayor Hollingsworth called for a public hearing at 6:56 p.m. Having no one from the audience to comment, the Mayor closed the public hearing at 6:56 p.m., and called for final consideration by the Aldermen. Alderwoman Glenda Howard made a motion, seconded by Alderman Elmore Mayfield, to adopt the ordinance. The title of the ordinance was read, a roll call vote was taken and the following result was had:

ALDERMAN JEDD LEWIS
ALDERMAN ELMORE MAYFIELD
ALDERMAN JIM PEARCE
ALDERWOMAN MARIE RIGGS
NAY: NONE

IV. ADJOURN MEETING:
There being no further business, the meeting of the Mayor and Board of Aldermen was adjourned at 6:59 p.m.
