RESOLUTION NO. 759 OF 2011
RESOLUTION REVOKING THE DEDICATION OF AN AREA OF PUBLIC STREET RIGHT-OF-WAY AND RETAINING A UTILITY SERVITUDE THEREON OF THE “RUSTON AND VERNON ROAD” (OLD TRENTON STREET) SITUATED SOUTH OF LINE AVENUE AND NORTH OF CLINIC WAY IN THE CITY OF RUSTON, LOUISIANA
WHEREAS, the following described public street right-of-way was occupied by the City of Ruston for the purpose of operating and maintaining a public street together with public utilities, said public street right-of-way being described as:
That certain 0.204 acre area of right-of-way, situated in, but not limited to, the SW _ of the NW _ of Section 25 and the SE _ of the NE _ of Section 26, Township 18 North - Range 3 West, Land District North of Red River, City of Ruston, Lincoln Parish, Louisiana, as shown on Boundary Survey of a Portion of SW _ of the NW _ of Section 25, T18N-R3W, City of Ruston, Lincoln Parish, Louisiana, Land District North of Red River as Requested by Dud Holland, Clinton Crutchfield, Jr., P.L.S., Dated July 11, 2011, recorded in Conveyance Book 1303, Page 502, of the records of Lincoln Parish, Louisiana.
WHEREAS, the above described portion of public street right-of-way is not now needed for that purpose; and,
WHEREAS, LSA-R.S. 48:701 provides, in part, that municipal corporations of the State may revoke and set aside the dedication of all roads, streets and alleyways laid out and dedicated to the public use within their respective limits, when the roads, streets or alleyways have been abandoned or are no longer needed for public purposes; and, WHEREAS, the above described portion of public street right-of-way is no longer needed for the purpose of operating and maintaining a public street or for public purposes and the City desires that the dedication for that purpose be revoked, set aside and abandoned; and, WHEREAS, the City desires to reserve and retain a right of use servitude or right-of-way (the “Servitude”) across the full width and length of the revoked portion of said public street right-of-way for the purposes of laying, constructing, operating, maintaining, repairing, replacing, or removing utility lines, including but not limited to sewer, water, electrical, drainage, and such appurtenances necessary or convenient in the use of the Servitude, together with the right of ingress and egress thereto; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. That the public street right-of-way described above is no longer needed as a public street or for public purposes and the dedication thereof is revoked, set aside and abandoned.
§2. The City retains the Servitude across the full width and length of the revoked portion of said public street right-of-way for the purposes of laying, constructing, operating, maintaining, repairing, replacing, or removing utility lines, including but not limited to sewer, water, electrical, drainage, and such appurtenances necessary or convenient in the use of the servitude, together with the right of ingress and egress thereto.
§3. The ownership of the land covered by the revocation of the above described public street right-of-way shall revert to the present owners of the land contiguous thereto in accordance with law.
§4. This Resolution shall become effective upon final adoption and publication in the manner required by law.
Said Resolution having been read and considered by a quorum of the Board of Aldermen, on motion to adopt by Alderman Elmore Mayfield, seconded by Alderman Jim Pearce, a record vote was taken and the following result was had:
