ORDINANCE NO. 1615 of 2011
ORDINANCE AUTHORIZING THE LEASE OF PROPERTY BY THE CITY OF RUSTON TO THE NORTH LOUISIANA MILITARY MUSEUM
WHEREAS, the City currently leases a 0.329 acre tract of land (the “Current Lease Property”) located in Memorial Park owned by the City to the North Louisiana Military Museum (the “Military Museum”), a non-profit corporation domiciled at Ruston, Lincoln Parish, Louisiana, organized exclusively for charitable and educational purposes, including, but not limited to, preserving items used by the military of this country in all armed conflicts, including, but not limited to, uniforms, accouterments, weapons, and equipment for the purpose of informing the general public and promoting greater public awareness of the role of the men and women of this area who served in such wars; and, WHEREAS, said current lease entitled “Surface Lease” (“the Current Surface Lease”) dated December 5, 1995 is authorized by City Ordinance No. 1211 of 1995; and, WHEREAS, the Military Museum proposes to lease from the City two additional tracts of land contiguous to the Current Lease Property comprising 0.088 acres (the ”New Lease Property”) located in Memorial Park owned by the City, which together with the Current Lease Property comprises a total of 0.417 acres, more or less, and as shown on “Plat of Boundary Survey Amending City of Ruston Survey of Proposed Military Museum Lease, Dated May 11, 1995,” prepared by Frank W. Miller, P.L.S., dated June 7, 2011; and, WHEREAS, the proposed Amended Lease has been reviewed and approved by the Office of State Parks, Department of Culture, Recreation and Tourism of the State of Louisiana for compliance with Land and Water Conservation Fund Project 22-00773 requirements; and, WHEREAS, the City proposes to amend the Current Surface Lease to include the New Lease Property; and, WHEREAS, the lease of the New Lease Property to the Military Museum is deemed to be in furtherance of the purpose for Memorial Park and in the best interest of the citizens of Ruston; and, WHEREAS, the New Lease Property is not needed for public purposes at this time, and, as such, it is in the best interest of the City that such be made available for lease to the Military Museum at this time; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The New Lease Property is hereby declared to be not needed for public purposes at this time.
§2. The City lease the New Lease Property to the Military Museum pursuant to the terms and conditions set forth in the Current Surface Lease.
§3. The Mayor, Dan Hollingsworth, is authorized and empowered to execute an Amended Surface Lease and/or other lease agreement or other documents required to amend the Current Surface Lease and/or lease the New Lease Property to the Military Museum on such other terms and conditions as deemed advisable and to execute any other documents necessary and proper to carry out this Ordinance and to fulfill its objectives and purposes.
§4. This Ordinance shall become effective upon final adoption and publication of the same in the manner prescribed by law.
This Ordinance was introduced on August 15, 2011, by Alderman Jedd Lewis; Notice of Public Hearing was published on August 19, 2011, August 22, 2011, and August 26, 2011. A Public Hearing was held, the title having been read and the Ordinance considered, on motion to adopt by Alderman Elmore Mayfield, and seconded by Alderman Jim Pearce, a record vote was taken and the following result was had:
