Notice is hereby given that by virtue of a Writ of Seizure and Sale issued out of the Honorable Third Judicial District Court in the above entitled and numbered cause, and to me directed, I have seized and taken into my possession and will offer for sale at public auction, at the principal front door of the Court House in Ruston, Lincoln Parish, LA, between the hours governing judicial sales on WEDNESDAY, August 31, 2011, beginning at 10:00 A.M., the following described property situated in Lincoln Parish, LA, to wit:
Lot 88 of Barnett Springs Place Subdivision, Unit 2, a subdivision to the City of Ruston, Lincoln Parish, as per plat and map of said subdivision on file and of record in the office of the Clerk of Court of Lincoln Parish, Louisiana; and All that portion of Lot 89 of Barnett Springs Place Subdivision, Unit 2, a subdivision to the City of Ruston, Louisiana, as per plat and map of said subdivision on file and of record in the office of the Clerk of Court of Lincoln Parish, Louisiana, which lies and is situated West of the following described boundary line: From Southwest corner of lot 89 of Barnett Place, run North 88 degrees 06 minutes East a distance of 15 feet to a 1/2 inch rebar set in place and to the point of beginning of the boundary line. From said point of beginning run thence North 2 degrees 47 minutes East a distance of 132.93 feet to a 1/2 inch rebar set in place and the termination of the boundary line, being on the right-of-way of Haskell Drive (50 foot radius from center of cul-de-sac) also being a chord distance of 14.13 feet Northwest from the original Northwest corner of Lot 89 of Barnett Springs Place Subdivision, Unit 2. This being the same boundary line established by conveyance and boundary agreement executed between Noryam Joel Harp, et ux and Gerald Duane Smalling, et ux, dated September 29, 1981, on file and of records in Conveyance Book 351 at Page 123 of the records of the Clerk of Court of Lincoln Parish, Louisiana; LESS AND EXCEPT All that portion of Lot 88 of Barnett Springs Place Subdivision, Unit 2, a subdivision to the City or Ruston, Louisiana, as per plat and map of said subdivision on file and of record in the office of the Clerk of Court of Lincoln Parish, Louisiana, which lies and is situated East of the following described boundary lines: From southeast corner of Lot 88 of Barnett Springs Place subdivision, Unit 2, as marked by an iron rod found in place, run North 88 degrees 06 minutes East a distance of 15 feet to a 1/2 inch rebar set in place and to the point of beginning run thence North 2 degrees 47 minutes East a distance of 132.93 feet to a 1/2 inch rebar set in place and the termination of the boundary line; subject to restrictions, servitudes, rights-of-ways and outstanding mineral rights of record affecting the property.
Seized as the property of defendant Yale Edward Hennessee and Judith Miller Hennessee and will be sold to satisfy said writ and all cost. Terms of sale cash without benefit of appraisement. This 22nd day of July, 2011.
